1. Acceptance of Terms

By accessing or using MyGhost ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

MyGhost is a personal safety application that allows users to:

  • Create "Ghost Messages" containing location, meeting details, and custom messages
  • Set up automated check-in notifications at customizable intervals
  • Designate trusted contacts to receive emergency notifications
  • Receive automatic alerts if they fail to respond to check-ins
  • Have their Ghost Messages automatically sent to trusted contacts in emergency situations

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account. You may register using:

  • Email and password
  • Google Sign-In
  • Apple Sign-In

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring you are at least 13 years old to use the Service

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Harass, abuse, or harm other users or third parties
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Create false or misleading Ghost Messages
  • Use the Service to stalk, harass, or harm others
  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble any part of the Service

5. Trusted Contacts

When you designate trusted contacts:

  • You are responsible for obtaining consent from contacts before adding them
  • You represent that you have permission to share their contact information with us
  • Trusted contacts will receive notifications only when you fail to respond to check-ins
  • You can add or remove trusted contacts at any time
  • We are not responsible for how trusted contacts use the information they receive

6. Location Services

By using the Service, you acknowledge and agree that:

  • Location services are essential for the Service to function
  • You grant us permission to access and use your location data when you create Ghost Messages
  • Location data will be shared with your trusted contacts if you fail to respond to check-ins
  • You can disable location services in your device settings, but this will limit Service functionality
  • Location accuracy depends on your device's GPS capabilities and network connectivity
  • We are not responsible for location inaccuracies or GPS failures

7. Emergency Situations

IMPORTANT: MyGhost is not a replacement for emergency services. In a true emergency, you should:

  • Call emergency services (911 in the United States, or your local emergency number) immediately
  • Not rely solely on MyGhost to contact emergency services
  • Understand that MyGhost sends notifications to your trusted contacts, not to emergency services

We are not responsible for delays in notification delivery, failures in the notification system, or any consequences resulting from reliance on the Service in emergency situations.

8. Service Availability

We strive to maintain Service availability but do not guarantee:

  • Uninterrupted or error-free operation
  • Immediate delivery of notifications
  • Compatibility with all devices or operating systems
  • Availability in all geographic locations

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any loss or damage resulting from Service unavailability.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by MyGhost and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. User Content

You retain ownership of any content you create using the Service (Ghost Messages, custom messages, etc.). By using the Service, you grant us a license to:

  • Store, process, and transmit your content as necessary to provide the Service
  • Share your content with your designated trusted contacts when triggered by check-in failures
  • Use anonymized, aggregated data for service improvement purposes

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or timeliness of notifications
  • Warranties that the Service will prevent harm or ensure your safety

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYGHOST SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from Service failures, delays, or interruptions
  • Damages resulting from reliance on the Service in emergency situations
  • Any harm or loss resulting from actions taken by trusted contacts

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless MyGhost and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, violation of these Terms, or infringement of any rights of another.

14. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction].
